When is Probate Required?
This answer depends on the state. In many states, the court looks to the value of the decedent’s estate. For instance, in Idaho and Utah, if your estate is valued at over $100k or if you own real estate, you must go through probate. In Colorado, this amount is $50k. In Oregon, it’s $75k but real estate can’t be valued over $200k. A lot of regulations, expense, and confusion.
This is why we recommend having a Trust. Generally, property placed in a Trust bypasses the probate process. Sometimes, a Trust can’t bypass probate altogether, but it will likely minimize it, taking the probate process from a formal one to a simplified/informal one.
