Will-Based Plans

A will is a document which only goes into effect upon your death. It is limited to naming the heirs for your property, appointing a guardian for minor children, and appointing an executor or personal representative.

Wills tend to be a bit less expensive than trusts, but they almost always require a court probate proceeding. These legal proceedings are time-consuming and very expensive.

Trust-Based Plans

A trust is an excellent tool to manage your legacy. A trust is effective as soon as you sign the paperwork and fund it by transferring property to it. A trust is a legal entity that owns property for you, while you still get to use and enjoy it. Done right, a trust is almost transparent- you’ll never know it’s there, at least until you need it. Property owned by a trust bypasses probate, making trusts far better at distributing property. And trusts provide some protection for your assets during your lifetime as well.

Living Will

 A living will has one job- it allows you to predetermine what you want to happen in the event you become clinically braindead. Should this unfortunate event occur, a living will allows you to make the choice of what to do ahead of time, rather than shouldering this difficult decision to your family.

Gun Trust

A gun trust is a specialized type of trust designed to “own” firearms and other items such as suppressors and short-barreled rifles regulated under the National Firearms Act (NFA). This trust not only can ensure that your firearms are specifically provided for during and after your life, but also prevents concerning legal issues with the ATF.

Power of Attorney

A power of attorney is a document that gives someone you appoint, your “attorney-in-fact” the authority to act in your behalf. Some POA’s are for health-related issues and permit the person to make health decisions for you if you can’t. Other POA’s permit a person to act for you in a financial or legal capacity, such as signing documents, opening a checking account, or interacting with companies.
